PandaSIM.com shall provide equipment and/or services to the customer upon acceptance of a customer's subscription or order. All orders are subject to our approval.
Service and equipment may not be used for any unlawful, fraudulent or abusive purpose. The Customer is prohibited from storing, distributing or transmitting any unlawful material through our services. The use of service and product must conform to requirements of all applicable laws.
You are responsible for proper care and use of PandaSIM equipment that you rent or buy. You must not transfer the ownership, sell or rent any equipment that we rent to you. We shall not be held responsible for any loss, damage, injury or inconvenience arising from any aspect of our service.PandaSIM has no control over problems relating to service provided by the phone networks. In the event of the equipment developing a fault during the rental period, contact us immediately and we will try our best to rectify the situation.
2.Delivery (of equipment)
Your order will be shipped out within 48 hours after your payment. Not all delivery services are available in all areas. A signature will be required at delivery. We will use reasonable efforts to deliver the Equipment by the requested delivery time. Deliveries made to destination countries throughout the world may be subject to Customs clearance delays, force majeure or other circumstances beyond PandaSIM's control. You may be liable to pay import duties and taxes - we have no control over these charges and cannot predict what they may be. If for any reason the Customer fails to accept Equipment that is delivered on time the Customer shall nevertheless be liable for the stated charge.
3. Billing, rates and payments
You are limited to two PandaSIM products per credit card. Equipment and shipping charges are taken from your credit card before shipping. Some calls made and received may be charged to your credit card as long as several months later due to delays in receiving call data from networks.
You are liable to pay in accordance with our current tariff/ rate schedule, and charges as specified at www.PandaSIM.com. There you can view all charge details online.
You must inform us of any changes to your credit card details. If we are unable to take payments we may suspend or terminate the service until outstanding charges are taken. Prior to travel you are advised to notify your credit card company to expect charges from China, which is where we proces our billing.
PandaSIM reserves the right to, in its sole discretion, to modify and/or add rates and charges, loyalty rewards, or cancel your order, without prior notice.
All applicable taxes shall be added to the usage and rental/purchase price of Pandaim equipment and SIM cards (unless the Customer has a tax-exempt status).
4.Loss, theft, damage and fraud policy
You must take all reasonable precautions to protect the equipment from theft, loss and damage.
The Customer must notify us immediately to report lost, stolen, or damaged Equipment / SIM cards / Internet Account, and to request disconnection of service. You may call us anytime, 24-hours per day, to report damage or disconnect service. Outside normal office hours our answering service will provide instructions.
You will be required to pay the call charges incurred as a consequence of the loss, theft or damage of the equipment which took place before notifying PandaSIM, as well as the full replacement costs in the following cases:
- Theft of the equipment from an unattended motor vehicle.
- Theft or loss of the equipment from an exhibition or trade-show.
- The non-return of batteries, charging equipment and any other accessories listed on the contract.
- Loss or damage caused by the willful act of yourself, your company's employees or any person using the equipment without your permission.
You must pay the charge within 14 days of the claim being authorized.
We require evidence of alleged loss or theft in the form of a police report. Your claims cannot be accepted unless you provide us with the following information: the Police Incident Number, the name and telephone number of the Police station, and the date on which the incident was reported.
This policy shall be void in the event of fraud, non-disclosure or alteration of risk.
The Customer agrees to provide reasonable co-operation in any investigation of unlawful use of Services or Equipment. If Loss/Theft/Damage protection is not purchased, the customer will be charged the full replacement value for any missing or damaged equipment.
The Customer is responsible for all charges incurred up until the time of said notification.
5. Confidentiality
Information provided by the Customer herein will not be shared or publicized by PandaSIM without the Customer's prior permission unless it is:
1) used in assessing credit performance or regarding collection of overdue payment;
2) supplied to the commissioning entity or Supplier provided that the information is to be used for the provision of Services and disclosure is made on a confidential basis.
3) provided to a law enforcement or investigative agency in connection with suspected unlawful activities or in the case that the Customer has provided false or misleading information to PandaSIM. By placing an order with PandaSIM you agree that PandaSIM has permission to provide order information to other companies to fulfill your request for a product or service, such as a shipping company, credit card processing company, or service partner. (Without your consent, these companies do not have the right to use the personally identifiable information we provide to them beyond what is necessary to assist us.) 6.Replacement or cancellation
If there is a fault with the equipment within 12 months of purchase, we will replace it. Please contact us for instructions.
If an order is cancelled you will be charged for any shipping charges incurred and may be subject to an administration fee.
Any problems you have with the equipment must be reported to us as soon as possible. Refunds will not be issued if we were not given the opportunity to solve the problem. We shall not be held responsible for any loss, damage, injury or inconvenience arising from any aspect of our service.
7.Refund policy
If you're not completely satisfied with the equipment for any reason, return it within 60 days of purchase for a refund. Write to us giving the reason why you are not satisfied, and we will send return instructions. Once we receive the phone, and provided you do not owe us for any call charges, we will refund the sale price of the phone. We will refund in full or in part our customers for any problems that arise from faulty equipment, such as chargers, car chargers, plug adapters, and handsets, as long as the problem is reported to us as soon as it happens. Refunds in total or in part will be limited to rental fees and or shipping charges. This refund policy is overruled by our terms and conditions (please read them completely). 8.Termination
We reserve the right to terminate the contract at any point, without explanation, and to repossess the equipment. Such termination may take immediate effect.PandaSIM may terminate this Agreement at any time without notice if it suspects any violation of any term or condition of this Agreement. The Customer shall be responsible for all charges outstanding at the time of termination. PandaSIM may also terminate Services in the event that another Contract for purchase of Service and/or Equipment expires or is terminated, provided that termination of the Services shall only be with respect to the Service provided pursuant to that Other Contract.
